Employment Basis vs. Independent Activity

Employment Basis

An employed applicant generally needs an appropriate relationship with a Portuguese host or employer.

Supporting evidence can include an Employment Contract, Promise of Employment, Host Institution Documentation, and other evidence accepted under the applicable procedure.

Independent Highly Qualified Activity

For independent activity, AIMA currently recognises evidence such as a Service Contract, Proof of Company Formation, Evidence of Professional Activity, and Recent Invoices / Receipts, together with the applicable tax and Social Security registration.

Professional Qualifications

The applicant must demonstrate the professional background necessary for the qualifying highly skilled activity.

Regulated Professions

Where the activity is a regulated profession, the applicant must satisfy the applicable Portuguese professional recognition or licensing requirements.

Highly Qualified Activity can involve minimum remuneration requirements depending on the legal basis, professional category, type of contract, and applicable Portuguese rules.

D3 Compared With Other Pathways

D3 / Highly Qualified Activity vs. Ordinary Employment Residence

D3 / Highly Qualified Activity is designed for advanced professional activity requiring high qualifications or specialised skills.

Ordinary Employment Residence is designed for Portuguese employment more generally.

D3 vs. EU Blue Card

These are separate pathways. Highly Qualified Activity under Article 90 is the Portuguese national residence framework for qualifying highly skilled activity.

The EU Blue Card is an EU-wide highly qualified employment framework with its own qualification rules, salary conditions, mobility rights and contract requirements.

A client who qualifies for Highly Qualified Activity may also potentially qualify for the EU Blue Card. The two routes should be compared before filing.

D3 vs. Tech Visa

Portugal also operates the Tech Visa. Tech Visa is designed for highly qualified professionals recruited by certified Portuguese companies and is a separate facilitated framework.

Tech Visa

Portugal's Tech Visa programme has operated since 1 January 2019. It is designed to facilitate recruitment of highly qualified third-country nationals by certified companies.

The Portuguese company must be appropriately certified under the Tech Visa programme.

Tech Visa Contract & Remuneration

The employment or services contract must generally have a minimum duration of 12 months.

AIMA currently states a minimum remuneration equal to 2.5 times the Portuguese Social Support Index (IAS).

12 Months / 2.5x IAS

The IAS changes over time. The exact euro amount should therefore be recalculated before each case.

Language & Qualification – Tech Visa

The applicant must have appropriate command of Portuguese, English, French or Spanish suitable for the functions performed.

A qualifying applicant generally needs ISCED Level 6 or higher.

For certain applicants with ISCED Level 5 technical qualifications, exceptional specialised technical competence can potentially be demonstrated through at least 5 years of relevant experience.

D3 Visa Documentation

Application Location

Portugal also has a separate Temporary Stay Visa for research, teaching or highly qualified activity lasting less than 1 year.

This should not be confused with the D3 Residence Visa intended for longer-term Portuguese residence.

After Entry Into Portugal

Following entry with the relevant Residence Visa, the applicant completes the Portuguese residence process with AIMA.

Residence Permit Validity & Renewal

AIMA currently states that Temporary Residence for Highly Qualified Activity is valid for 2 years from issuance. It can generally be renewed for successive periods of 3 years.

2 Years + 3 Year Renewals

This is the residence-card validity. It does not automatically mean the applicant will qualify for Permanent Residence or citizenship after one renewal.

Family, Long-Term Residence & Citizenship

A qualifying Highly Qualified Activity Residence holder can potentially apply for Family Reunification.

Qualifying legal residence can potentially contribute toward future Permanent Residence or other long-term status.

Residence under the D3 / Highly Qualified Activity pathway can potentially form part of a future citizenship strategy. However, Portuguese Citizenship is a separate nationality procedure.

Schengen Travel

A valid Portuguese residence permit generally allows qualifying short-term travel within the Schengen Area.

However, Portuguese Residence does not automatically provide unrestricted employment rights throughout the EU.
