Polish immigration law contains a general Temporary Residence provision for situations that justify residence in Poland but are not specifically regulated under another dedicated residence pathway.

The legal basis is often found in Article 187(8) of the Polish Act on Foreigners, which functions as a specialised residual residence category.

Who Can Potentially Qualify?

The pathway can potentially be available to qualifying:

Applicants must demonstrate circumstances genuinely justifying residence in Poland for more than 3 months.

This is not a universal alternative for applicants who fail to qualify for standard categories such as work, business, or student residence.

Education & Training

Covers certain forms of education outside the principal full-time higher-education pathway, such as part-time studies, postgraduate studies, or language courses.

It also includes qualifying vocational training intended to acquire professional skills or prepare for a specific position.

EU Long-Term Resident Mobility

A person who already holds EU Long-Term Resident status issued by another EU Member State may potentially obtain Polish Temporary Residence when moving to Poland for qualifying purposes.

Individual Family Situations

Other-circumstances residence can become relevant in certain family situations where the applicant does not qualify under the standard family reunification framework.
