Bulgaria provides Permanent Residence to third-country nationals who qualify under one of the specific grounds established by Bulgarian immigration law.

Unlike an ordinary temporary or prolonged residence permit, Permanent Residence provides residence in Bulgaria for an indefinite period.

What Is Bulgarian Permanent Residence?

Permanent Residence is not the same as Prolonged Residence, EU Long-Term Resident Status, or Bulgarian Citizenship.

Permanent Residence vs. EU Long-Term Resident Status

These two statuses must not be confused.

EU Long-Term Resident Status primarily operates within the EU Long-Term Residents framework and generally requires a qualifying five-year residence history.

Bulgarian Permanent Residence is a Bulgarian national status available under specific statutory grounds established in Bulgarian immigration law.

Some applicants may qualify through residence history. Others can potentially qualify through specific Family Grounds, Bulgarian Origin, Investment Grounds, or Other Statutory Grounds.

Main Permanent Residence Pathways

Bulgarian law provides several separate grounds. Potential categories include:

1. Five-Year Qualifying Residence

A third-country national can potentially qualify after 5 years of legal and continuous residence in Bulgaria immediately before applying.

Under this particular Permanent Residence route, the applicant generally must not have been outside Bulgaria for more than 30 months in total during the relevant five-year period.

This is different from the absence calculation used for EU Long-Term Resident Status. The two pathways must therefore be calculated separately.

For the relevant statutory residence calculation, certain periods of residence for study are counted only 50%. The applicant's complete immigration history should therefore be reviewed before eligibility is confirmed.

2. Bulgarian Origin

Persons who qualify as being of Bulgarian Origin can potentially obtain Permanent Residence under the applicable statutory provisions.

Evidence of Bulgarian origin must satisfy Bulgarian legal requirements.

3. Spouse of a Permanent Resident

A qualifying spouse of a third-country national permanently residing in Bulgaria can potentially obtain Permanent Residence.

Under the standard statutory route, this can require 5 years from conclusion of the civil marriage and 5 years of legal and continuous residence in Bulgaria.

Specific exceptions can apply to certain investment-related cases.

4. Minor Children

Qualifying unmarried minor children of a foreign national permanently residing in Bulgaria can potentially obtain Permanent Residence.

5. Parents of Bulgarian Citizens

A parent of a Bulgarian citizen can potentially qualify where the applicable requirements are satisfied.

The standard statutory framework includes 3 years of legal and continuous residence in Bulgaria together with satisfaction of the applicable maintenance/support requirements.

6. Investment-Based Permanent Residence

Investment Permanent Residence should never be marketed simply as "buy property and get Permanent Residence." The exact statutory investment category must be satisfied.

Bulgarian law also provides specific Permanent Residence grounds connected with qualifying investments. These are specialised statutory pathways.

Depending on the exact provision, qualifying investments can involve specific Financial Instruments, Bulgarian Investment Structures, Capital Investments, Certified Investments, or Other Legally Defined Investment Categories.

Investment Requirements

Different investment routes have different Minimum Amounts, Eligible Assets, Holding Requirements, Certification Requirements, Source-of-Funds Requirements, and Continuing Compliance Obligations.

Each investment case must therefore be assessed separately.

Property Purchase and Company Formation

Purchasing ordinary Bulgarian real estate does not automatically provide Permanent Residence. Property ownership is not the same as Permanent Residence.

Likewise, registering a Bulgarian company does not automatically provide Permanent Residence.

Certain qualifying business or investment structures can potentially create immigration possibilities. However, ordinary company ownership alone is insufficient.

Permanent Residence Duration

Permanent Residence is granted for an indefinite period.

The underlying residence status should be distinguished from the physical residence document. Identity/residence documents can require renewal even though the underlying Permanent Residence status is indefinite.

Work Rights

Permanent Residents generally have free access to the Bulgarian labour market. This means they do not generally require an ordinary Bulgarian work permit to undertake employment.

These employment rights apply in Bulgaria. They do not automatically provide unrestricted employment rights throughout the European Union.

Social Rights

Permanent Residents can benefit from stronger access to Bulgarian Employment, Social Security, Public Services, and Other Rights, subject to the applicable Bulgarian legislation.

Family Reunification

Permanent Residence can also provide a stronger basis for Family Reunification. Qualifying family members can potentially obtain Bulgarian residence under the applicable family rules.

Qualifying unmarried minor children of a Permanent Resident can potentially have a direct statutory Permanent Residence pathway.

Permanent Residence & Schengen

A Bulgarian Permanent Resident can generally use a valid Bulgarian residence document for qualifying short-term travel within the Schengen Area under the applicable Schengen rules.

Schengen travel does not equal EU-wide employment. Permanent Residence in Bulgaria does not automatically provide a right to permanently relocate to or work in Austria or elsewhere in the EU. The applicant must satisfy the applicable rules of the destination country.

Permanent Residence vs. Citizenship

This distinction is fundamental.

Permanent Residence provides indefinite residence rights in Bulgaria.

Bulgarian Citizenship provides Bulgarian Nationality, a Bulgarian Passport, EU Citizenship, and EU Free-Movement Rights.

Permanent Residence does not automatically become citizenship.

Citizenship Strategy

For some qualifying Permanent Residents, Bulgarian naturalisation can potentially become the next long-term immigration stage.

However, citizenship has separate requirements concerning matters such as Residence Status, Residence History, Criminal Record, Income/Occupation, Bulgarian Language, and Other Statutory Conditions.
