Unmarried Partner of a Polish Citizen

Residence in Poland Based on Genuine Family Life

← Back to Poland

Marriage is not the only situation in which family life can be relevant under Polish immigration law.

A third-country national who is in a genuine and stable relationship with a Polish citizen may potentially apply for a Temporary Residence Permit due to other circumstances, where the foreign national demonstrates that they maintain family life with a Polish citizen residing in Poland.

This is different from the dedicated residence pathway available to a legally married spouse of a Polish citizen.

CETO Global Immigration Consulting & Partners assists international couples in assessing their circumstances, preparing evidence of genuine family life and coordinating the appropriate Polish residence procedure together with qualified legal and immigration professionals.

What is Unmarried Partner Residence?

Polish immigration law does not treat an unmarried partner exactly the same as a husband or wife. However, a foreign national who genuinely maintains family life with a Polish citizen can potentially qualify for Temporary Residence under the applicable other-circumstances provisions.

The existence of genuine family life must be demonstrated. This pathway is not an automatic residence for a partner, boyfriend, girlfriend, or fiancé, nor is it based merely on dating.

  • One Partner Is a Polish Citizen
  • The Polish Citizen Resides in Poland
  • The Couple Is Not Legally Married
  • A Genuine Family Relationship Exists
  • The Relationship Justifies Residence in Poland for More Than 3 Months
  • The Remaining Immigration Requirements Are Satisfied.

Genuine Family Life

The central question is whether the relationship constitutes genuine family life. Authorities can examine the complete circumstances of the relationship to ensure it is stable and authentic.

Relationship Evidence & Assessment

There is no single “partner certificate” that automatically creates a right of residence. The authorities assess the overall circumstances.

Relationship Evidence

  • Evidence of Living Together
  • Joint Lease Agreements
  • Shared Household Expenses
  • Joint Bank or Financial Documentation
  • Travel History and Photographs Together
  • Communication History
  • Common Children
  • Statements Concerning the Relationship

Assessment Factors

A longer relationship can provide stronger evidence of genuine family life, but the assessment is not based on a fixed number of months or years.

The quality and reality of the family relationship are the primary focus.

Evidence that the couple lives together can be particularly important.

Common Children

Having a child together can provide important evidence of established family life. The child's birth certificate, citizenship, residence status, and parental relationship can all become relevant to the application.

Where the couple has a child with Polish citizenship, additional family and immigration considerations may apply. The appropriate residence basis should be assessed before filing.

Financial & Personal Requirements

Unlike the dedicated spouse pathway, an unmarried partner generally needs to satisfy several additional requirements.

  • Health Insurance: Qualifying coverage for medical treatment costs in Poland.
  • Financial Resources: Stable and regular income sufficient to cover living costs for themselves and dependent family members.
  • Accommodation: An assured place of residence in Poland with appropriate supporting evidence.

Statutory financial thresholds should always be verified at the time of application.

Documentation

Depending on the case, documentation can potentially include:

  • Valid Passport
  • Proof of Polish Partner's Citizenship and Residence
  • Relationship Evidence
  • Joint Accommodation Evidence
  • Financial Documentation
  • Health Insurance
  • Birth Certificates of Common Children

Application & Procedure

Where the applicant is legally residing in Poland, the application must be submitted according to the applicable Temporary Residence procedure before the current legal stay expires.

The application is decided by the competent Voivode according to the applicant's place of residence. If approved, the partner receives a Temporary Residence Permit.

Work Rights - Very Important

This pathway must not be confused with the residence permit available to the spouse of a Polish citizen. An unmarried partner's permit does not automatically provide the same unrestricted labour-market position.

Before beginning employment, the person's residence decision, card, and work-permit exemptions should be checked individually.

Separate Work Authorisation May Apply

Partner Residence vs. Marriage

Unmarried Partner

Must demonstrate genuine family life under 'other circumstances' provisions.

Requires proof of income, insurance, and separate work authorisation assessment.

Spouse of a Polish Citizen

Has access to a dedicated family residence pathway with stronger statutory immigration rights.

Provides a more direct pathway to permanent residence and citizenship.

Future Pathway & Transition

Where an unmarried international couple later legally marries, the foreign partner's immigration basis can potentially change to the dedicated spouse-based framework.

Marriage does not retrospectively convert previous unmarried-partner residence. Future Permanent Residence and citizenship requirements must be calculated according to the applicable rules.

  • Unmarried Family Life
  • Temporary Residence (Other Circumstances)
  • Marriage
  • Spouse-Based Temporary Residence
  • Qualifying Permanent Residence
  • Potential Future Citizenship

Case Examples

Long-Term Couple

A Polish citizen lives in Warsaw with an international partner. They are not married but have a genuine long-term relationship and shared household. They may potentially apply for Temporary Residence based on family life.

New Relationship

A foreign national has recently started dating a Polish citizen. The existence of a romantic relationship alone does not establish eligibility; genuine family life must be proven.

Couple with Child

An unmarried couple with a common child. Their circumstances provide significant evidence of family life, but the status of both parents and the child must be assessed individually.

Frequently Asked Questions

Do I have to be married to live with my Polish partner?

Not necessarily. A qualifying unmarried partner may potentially obtain Temporary Residence where genuine family life with a Polish citizen residing in Poland is demonstrated.

Is having a Polish boyfriend or girlfriend enough?

No. A relationship alone does not automatically create a residence right. The applicant must demonstrate genuine family life and satisfy all immigration requirements.

Do I need to show income and health insurance?

Generally yes. Stable and regular income and healthcare coverage are required under the relevant other-circumstances residence framework.

Can I work automatically?

Do not assume so. The unmarried-partner pathway does not automatically provide the same labour-market rights as the spouse pathway. Work authorisation must be checked separately.

Does this lead directly to Permanent Residence or Citizenship?

No. The special marriage-based pathways apply only to qualifying spouses. Unmarried partners must follow the general rules for these statuses.
