Austria offers a dedicated residence pathway for qualified third-country nationals who plan to carry out research activities at eligible Austrian research institutions.

The Settlement Permit – Researcher allows qualifying researchers to reside in Austria and work within the scope of their approved research activity.

Who Can Apply?

Applicants generally need to have an admission agreement / hosting agreement with either a certified Austrian research institution, or a research institution that does not require certification under Austrian residence law, such as certain universities.

Hosting Agreement

The hosting agreement is used as evidence that the researcher has a qualifying research purpose in Austria.

Validity

The Settlement Permit – Researcher is generally issued for 2 years. If the hosting agreement is valid for a shorter period, the permit is generally issued for the duration of the hosting agreement plus 3 months.

This provides researchers with a short additional period following the completion of their research agreement.

Application From Austria

An important procedural advantage applies to researchers. Certain applicants seeking a Settlement Permit – Researcher may submit their initial application after lawful entry and during lawful residence in Austria.

This is an exception to the general rule that many first residence applications must be submitted from abroad. For applicants residing in Vienna, the competent residence authority is generally MA 35.

Application possible during lawful residence in Austria

Family Relocation

Eligible family members of researchers may also have access to Austrian family residence pathways. Depending on the applicable residence title and individual circumstances, qualifying family members can obtain Austrian residence rights.

Family members of certain researchers are also exempt from some pre-entry German-language requirements.

Researcher Mobility Within the EU

Austria also provides a specific residence pathway for researchers who already hold a valid researcher residence title issued by another EU Member State. The Residence Permit – Researcher Mobility can allow qualifying researchers to carry out part of their research activity in Austria under EU mobility rules.

Applicants generally need:

  • A valid researcher residence title from another EU Member State
  • Activity at an eligible Austrian research institution
  • A doctoral degree or suitable higher-education qualification giving access to doctoral studies
  • Compliance with the applicable mobility requirements

The Austrian permit cannot extend beyond the validity of the researcher residence title issued by the other Member State.
